However, the series is mainly concerned with the National Arbitration Order, 1305, which set up the National Arbitration Tribunal. Following the fall of France in 1940, to help the war effort, the Trades Union Congress had agreed to the Order, which made strikes and lockouts illegal. It was not until 1951 that the Order was replaced by the Industrial Disputes Tribunal, which had no provisions for making strikes and lockouts illegal. The delay in this revision caused much protest from trade unions. Copy of above agreement. MSS. 292/252.81/1-19 Nottingham Miners' Dispute 1926-9This brief series describes the situation in the Nottingham Coal-fields after the General Strike. The Nottingham and District Miners' Industrial Union was set up and in an effort to stop its takeover of the Nottingham area a ballot was organised under Trades Union Congress auspices. The ballot was in favour of the Nottinghamshire Miners Association, but George Spencer, founder of the Industrial Union, tried to dispute the result on the grounds that the ballot was held in Nottinghamshire Miners Association majority pits and alleging interference at pits. The series is also concerned with attempts by the Trades Union Congress and Miners' Federation of Great Britain to stop the Coal Owners from victimising Nottinghamshire Miners Association members and forcing new employees into the Spencer Union. The National Union of Seamen members were prosecuted under section 225 of 1894 Merchant Shipping Act whereby a seaman could be summarily punished for quitting the ship without leave before the ship is placed in security, for disobeying lawful commands, for continued wilful disobedience/neglect of duty, for combining with other crew members to disobey lawful commands/neglect duty/impede navigation of the ship. The National Union of Seamen had previously been examining this Act with a view to suggesting amendments which might benefit their members. In November 1927 a group of employers headed by Sir Alfred Mond (later Lord Melchett) wrote to the Trades Union Congress suggesting a joint meeting. They hoped, following the lessons of 1926, to begin a fresh era of industrial relations between employers and employed. Thus the Joint Committee on Industrial Re-organisation and Industrial Relations was formed. Its final report proposed that consultation between the Trades Union Congress and employers could take place through a National Industrial Council.
